Welcome to Asklumia
By accessing the AskLumia website, you acknowledge that you have read, understood, and agreed to be bound by the following Terms of Service. These terms apply to the entire Website and to any communication, including but not limited to email or other forms, between you and AskLumia.
1. Limitation of Liability
1.1. Under no circumstances shall AskLumia or its team be held liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data or profits, arising from the use or inability to use the materials on this website, even if AskLumia or an authorized representative has been advised of the possibility of such damages. If your use of materials from this website results in the need for servicing, repair, or correction of equipment or data, you bear all associated costs.
1.2. AskLumia does not take responsibility for any outcomes resulting from the use of its resources. We reserve the right to modify prices and update the terms of resource usage at any time without prior notice.
2. License
2.1. AskLumia grants you a limited, revocable, non-exclusive, and non-transferable license to access and use the AskLumia Service strictly in accordance with these Terms of Service.
2.2. These Terms constitute a binding agreement between you and AskLumia (referred to herein as "AskLumia", "we", "us", or "our"), the provider of the AskLumia website and services (collectively referred to as the "AskLumia Service" or "Service").
2.3. By using the AskLumia Service, you agree to be bound by these Terms of Service. If you do not accept these Terms of Service, please refrain from using the service. "You" refers both to you individually and to the entity you represent, if applicable. Violation of any of these Terms of Service may result in the suspension or termination of your account and access to the AskLumia Service without notice.
2.4. To make these Terms of Service easier to understand, here's what we mean when we use certain terms:
- Cookie: A small file stored by your web browser, created by a website to help recognize your browser, track analytics, and remember things like your language preference or login details.
- Company: When we say "Company," "we," "us," or "our," we're referring to Populix Intelligence Development Pte. Ltd., located at 36 Robinson Road, #20-01 City House, Singapore 068877 the entity responsible for the operation of AskLumia.
- Service: The services provided by AskLumia, as described in these Terms and on our platform.
- Third-Party Service: External partners such as advertisers, sponsors, or marketing affiliates who may provide content or offer products and services we believe could interest you.
- Website: Refers to AskLumia's official websites, accessible at www.asklumia.ai.
- You: Refers to any individual or organization registered with AskLumia to access or use our Services.
3. Registration
3.1. Registration. You must provide accurate and complete information to register for an account to use our Services. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account. If you create an account or use the Services on behalf of another person or entity, you must have the authority to accept these Terms on their behalf.
3.2. Account and password confidentiality and activities of an account are the personal responsibility of the owner of the account. We are not responsible for any activities carried out by an account, except for those carried out by Us and directly impact the account owner.
3.3. Corporate domains. If you create an account using an email address owned by an organization (for example, your employer), that account may be added to the organization's business account with us, in which case we will provide notice to you so that you can help facilitate the transfer of your account (unless your organization has already provided notice to you that it may monitor and control your account). Once your account is transferred, the organization's administrator will be able to control your account, including being able to access Content (defined below) and restrict or remove your access to the account.
4. Minimum Age Requirement
To use our Services, you must be at least 18 years old or the legal minimum age required in your country to give valid consent to use online services. If you are under 18, you must have permission from a parent or legal guardian before using AskLumia.
5. Paid Account
5.1. Billing. If you purchase any Services, you will provide complete and accurate billing information, including a valid payment method. For paid subscriptions, we will automatically charge your payment method on each agreed-upon periodic renewal until you cancel. You're responsible for all applicable taxes, and we'll charge tax when required. If your payment cannot be completed, we may downgrade your account or suspend your access to our Services until payment is received.
5.2. Cancellation. You can cancel your paid subscription at any time. Payments are non-refundable, except where required by law. These Terms do not override any mandatory local laws regarding your cancellation rights.
5.3. Changes. We may change our prices from time to time. If we increase our subscription prices, we will give you notice and any price increase will take effect on your next renewal so that you can cancel if you do not agree to the price increase.
6. What You're Allowed to Do
As long as you follow these Terms, you're welcome to access and use our Services. When doing so, you must comply with all applicable laws as well as any guidelines, documentation, or policies we provide.
7. What You're Not Allowed to Do
You may not use our Services in any illegal, harmful, or abusive way. Specifically, you may not (and must not allow anyone else to): a. sell, rent, license, lease, assign, distribute, or otherwise make our website or platform available to others for commercial use; alter, reverse engineer, decompile, decode, or create derivative works from any part of the website. b. remove or tamper with any ownership or intellectual property notices (e.g., copyright or trademark notices) from AskLumia or our partners, suppliers, or licensors. c. access, extract, or harvest any data or Output (as defined below) from the Services through automatic or programmatic means, except as expressly permitted in writing by AskLumia; d. present, publish, or otherwise represent any Output as having been generated by a human when such Output was produced by the Services; e. interfere with, disrupt, or attempt to circumvent the operation of the Services, including without limitation any rate limits, access restrictions, security protocols, or protective measures implemented by AskLumia; and/or f. use any Output or other materials derived from the Services to develop, train, or improve any product or model that competes, directly or indirectly, with the products, models, or services of AskLumia.
8. Content
You may provide information or data to our Services ("Input"), and receive responses generated by the Services ("Output"). Together, these are referred to as "Content." You are fully responsible for your Content and must ensure it complies with all relevant laws and these Terms. By submitting Input, you confirm that you have the necessary rights and permissions to do so.
8.1. Ownership of Content. Subject to applicable laws, you retain ownership of the Input you provide. You also own the Output generated in response to your Input. We transfer any rights we may have in the Output to you, to the extent legally possible.
8.2. Content with Similarit. Because of how Al works, the Output you receive may be similar or identical to what other users receive. This means your ownership rights apply only to your specific Output and not to similar content generated for others.
8.3. How We Use Content. We may use Content to operate, improve, maintain, and develop our Services, to comply with legal requirements, enforce our policies, and ensure the security and integrity of the Services.
9. Third-Party Services
9.1. Some parts of our Services may rely on or integrate with third-party tools, software, or content ("Third-Party Services"). Features like browsing or outputs from integrated tools may involve data or results from these third parties ("Third-Party Output"). These are governed by their own terms of use, and AskLumia is not responsible for how they operate.
9.2. We may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services.
9.3. You acknowledge and agree that AskLumia shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. AskLumia does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.
9.4. Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.
10. Your Suggestions
10.1. Any feedback, ideas, comments, or suggestions you share with AskLumia about the website (collectively referred to as "Suggestions") will belong solely and exclusively to AskLumia.
10.2. We may use, copy, modify, publish, or share your Suggestions for any purpose, without needing to credit you or provide any form of compensation.
11. Copyright Infringement Notification
If you believe that content on our website violates your copyright, please contact us and include the following: a. your physical or digital signature (or that of someone authorized to act for the copyright owner); b. a clear description of the material you believe is infringing; c. your contact details (address, phone number, and email); d. a statement that you believe in good faith that the use is not authorized by the copyright owner; and e. a declaration that the information provided is accurate and that you are authorized to act on behalf of the copyright owner, under penalty of perjury.
12. Disclaimer of Warranties
12.1. Our website and services are provided "as is" and "as available," without any guarantees.
12.2. To the fullest extent allowed by law, AskLumia and its affiliates disclaim all warranties-whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
12.3. We do not guarantee that the site will be uninterrupted, error-free, secure, or meet your specific needs. Some regions may not allow exclusions of certain warranties, so these may not apply to you.
13. Limitation of Liability
13.1. Regardless of any damages you may suffer, the total liability of AskLumia and its partners under this agreement is limited to the amount you paid (if any) to use the website.
13.2. To the extent allowed by law, AskLumia and its suppliers are not liable for any indirect, incidental, special, or consequential damages, such as lost profits, data loss, privacy breaches, or business interruptions, even if we were informed such damages might occur. Some jurisdictions may not allow this limitation, so it may not apply to you.
14. Severability
14.1. If any part of this Terms of Service is found invalid or unenforceable, it will be adjusted to comply with applicable laws, and the rest will still be enforceable.
14.2. This Terms of Service, together with our Privacy Policy and any posted legal notices, is the complete agreement between you and AskLumia.
14.3. Any waiver of a provision does not waive other provisions. Legal claims relating to our services must be brought within one (1) year, or they are permanently barred.
15. Waiver
15.1. Not enforcing a right or obligation under this Terms of Service does not mean we waive that right later.
15.2. Delays or partial enforcement do not stop future enforcement of that right or others.
15.3. If there is any conflict between this Terms of Service and other terms, this Terms of Service takes precedence.
16. Termination and Breach of Terms of Use
16.1. You are free to stop using Services at any time. We reserve the right to suspend or terminate your access to our Service or delete your account if we determine: a. you breached these Terms of Service or Privacy Policy; b. we must do so to comply with the law c. your use of Services could cause risk or harm to AskLumia, or users, or anyone else.
16.2. Appeals. If you believe we have suspended or terminated your account in error, you can file an appeal with us by contacting our Support team at support@asklumia.ai.
16.3. If you violate these Terms of Service or Privacy Policy, we may take the following actions as deemed appropriate in the circumstances: a. immediate, temporary, or permanent withdrawal of your right to use the Website; b. provide warnings to the User; C. File a lawsuit against the User, or d. Disclosing User information to the relevant law enforcement officers.
16.4. You agree to indemnify us against all costs, losses, damages, expenses, and liabilities (including, but not limited to, reasonable administrative and penalty) suffered, incurred, or paid by us as a result of a breach of these Terms of Services and Privacy Policy.
17. Entire Agreement
This Terms of Service is the complete and final understanding between you and AskLumia regarding your use of the website. It replaces all previous discussions or agreements, whether written or verbal.
18. Changes to Our Terms
We may update our Services and policies from time to time, which may require adjustments to these Terms. If changes are made, we'll notify you-unless the law says otherwise. If you continue using our Services after being notified, it means you accept the updated Terms. If you don't agree, you may stop using the Services and delete your account.
19. Intellectual Property
All content, features, and functionality on this website are owned by AskLumia or its licensors and are protected by local and international intellectual property laws. You may not copy, modify, share, or download any part of the website without written permission, unless these Terms explicitly allow it. Unauthorized use is strictly prohibited.
20. Dispute Resolution Through Arbitration
The laws of Singapore, excluding its conflicts of law rules, shall govern this Terms of Service and your use of AskLumia. Your use of AskLumia may also be subject to other local, state, national, or international laws.
21. Notice of Dispute
This section applies to any disagreement between you and AskLumia, except claims involving the protection or enforcement of intellectual property rights. A "Dispute" includes any legal claim about our Services or this Terms of Service, no matter the legal theory used, and is interpreted as broadly as legally allowed.
a. If a dispute arises, either you or AskLumia must first send a written notice outlining: (a) your name and contact details, (b) a description of the issue, and (c) the resolution you're seeking. b. You must send your notice via the "Contact Us" form at our Website or via email support@asklumia.ai. We will send ours to the email or mailing address you've provided. Both sides agree to try resolving the issue informally within 60 days of receiving the notice. If not resolved in that time, either party may pursue further legal action as stipulated below. c. If the issue is not resolved informally within 60 days of receiving the notice, either party may initiate legal proceedings. All such proceedings shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the Arbitration Rules of the SIAC for the time being in force, which rules are deemed to be incorporated by reference into this clause. The seat and venue of arbitration shall be Singapore, and the arbitration shall be conducted in English.
22. Miscellaneous
a. If a court finds any part of these Terms unenforceable, the rest will still apply. Any waiver must be in writing and signed by an authorized AskLumia representative to be valid. AskLumia has the right to seek court orders or equitable remedies without needing to post a bond if you breach (or are about to breach) the Terms. b. Our Services are operated from our offices, and may not be legal or appropriate in other jurisdictions. If you access them from elsewhere, you do so at your own risk and must follow local laws. c. These Terms of Services, along with our Privacy Policy, form the complete agreement between you and AskLumia. You cannot change them unilaterally. Section titles are only for convenience and have no legal effect.
23. Disclaimer
25.1. AskLumia does not guarantee the accuracy, completeness, or reliability of any content, code, or information on the Service. We make no promises or warranties, and we are not responsible for any direct, indirect, incidental, or consequential damages related to your use of the Service.
25.2. We may change the Service's content at any time without notice. Everything on the site is provided "as is" and "as available," with no express or implied warranties of any kind.
25.3. As we sometimes distribute third-party content, we don't control or guarantee its accuracy. We also disclaim any warranties relating to third-party content, including merchantability, fitness for a particular purpose, or non-infringement.
25.4. No advice, whether spoken or written, from AskLumia or our partners creates a warranty.
